This Privacy Policy applies to all who (i) visit or use our websites, social media pages, and other online services that link to this Privacy Policy; and (ii) purchase, use, or access any products or services offered by Ketos Health, LLC (collectively, the “Site,” “Products,” or “Services”).

This Privacy Policy explains how Ketos Health LLC (“Kētos,” “we,” “our,” or “us”) collects, uses, discloses, and otherwise processes information about you.

This Privacy Policy is incorporated into our Terms of Service (and any other terms that apply when you use our Services or purchase our Products). By visiting, accessing, or using the Services, you agree to this Privacy Policy. If you do not agree with the practices described in this Privacy Policy, please stop using the Services and do not provide information to us.

We may modify this Privacy Policy from time to time. If we make material changes, we will provide notice as required by law, such as by posting an updated policy on the Site and updating the “Last updated” date, and in some cases providing additional notice (for example, by email or via your account). Your continued use of the Services after the updated Privacy Policy becomes effective means you accept the updated policy.

1. Information collection

1.1 What information we collect

We collect information directly from you, automatically when you use the Services, and from third parties (such as service providers and advertising partners). The information we collect may include information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked with you (often called “personal information” under various laws).

We may collect the following categories of information:

  • Account and contact information: such as your name, email address, shipping address, billing address, phone number, account login details, and any information you choose to include in your profile or account.
  • Purchase and transaction information: such as products purchased, order history, subscription status (if applicable), returns and exchanges, gift purchases, discount code usage, customer service interactions related to an order, and shipping and delivery information.
  • Payment information: payment card information and related billing details are typically collected and processed by our payment processors and/or by the ecommerce platform we use to operate our store. We generally receive limited information (such as a payment token, partial card number, and payment status) rather than full payment card details.
  • Customer communications and support information: such as emails, chats, messages, support tickets, call recordings where permitted by law, and the content of communications you send to us.
  • Reviews and user content: such as product reviews, testimonials, survey responses, comments, images, or other content you submit through the Services or publicly post in connection with Kētos.
  • Optional wellness-related information you choose to provide: because Kētos is positioned around fasting and nutritional ketosis, you might choose to provide wellness-related information such as fasting goals, dietary preferences, supplement preferences, sensitivities, or similar context (for example, in a quiz, survey, customer support conversation, or product recommendation flow). In some jurisdictions, certain wellness-related information may be treated as “consumer health data” even when collected by a non-healthcare company. See Section 4.
  • Device, usage, and web-behavior information: such as your IP address, device identifiers, browser type, operating system, language settings, approximate location derived from IP, pages viewed, links clicked, time spent on pages, referral URLs, and interactions with emails (for example, opens and clicks).
  • Cookie and tracking information: we and our partners may use cookies, pixels, software development kits (SDKs), and similar technologies to recognize you, remember preferences, secure the Services, measure performance, and (where enabled) support advertising and analytics. See Section 5.
  • Inferences and preferences: such as inferences about your interests and preferences based on your purchases and interactions with the Services (for example, which product pages you view most).

1.2 How we collect information

We may collect information when you:

  • Create an account or subscribe to communications
  • Place an order, check out, or request a refund/return
  • Contact customer support or otherwise communicate with us
  • Participate in surveys, quizzes, promotions, or referral programs
  • Post a review or submit user content
  • Browse the Site, interact with emails, or interact with our ads
  • Connect with our pages on social platforms or engage with our social posts

1.3 Ecommerce platform and Shopify

Our online store is powered by Shopify. When you visit or make a purchase through our Shopify-powered storefront, Shopify may process certain information to provide and secure the ecommerce functionality (for example, checkout, payment processing integrations, fraud prevention, hosting, and store analytics). Shopify’s own policies and contractual terms may apply to certain processing by Shopify.


We may also use Shopify features such as Shop Pay, Shopify pixels, and other Shopify services and apps. Third-party apps you interact with may also collect information according to their own policies.

2. Information use

2.1 How we use your information

We use the information we collect for business and commercial purposes including to:

  • Process orders and fulfill purchases (including payment processing, shipping, returns, and customer notifications)
  • Provide customer service and respond to requests
  • Create and manage your account and preferences
  • Verify your identity (including to protect against fraud and unauthorized activity)
  • Operate, maintain, and improve the Services and Products (including troubleshooting and analytics)
  • Develop new products, services, and features
  • Send transactional communications (such as receipts, shipping updates, and account notices)
  • Send marketing communications where permitted and in accordance with your choices
  • Personalize content and product recommendations (for example, showing products you may be interested in)
  • Administer promotions, sweepstakes, surveys, and referral programs
  • Detect, prevent, and respond to fraud, abuse, security incidents, and illegal activity
  • Comply with legal obligations and enforce our terms and policies
  • Maintain business records, accounting, and reporting

2.2 Marketing, advertising, and measurement

We may use information to market our Products and measure the effectiveness of our marketing. This can include targeted advertising (sometimes called interest-based advertising), where permitted and subject to your choices.

Depending on the state you live in and how advertising technologies are configured, certain disclosures of information (such as identifiers and device/usage data) to advertising partners may be considered “sharing” for targeted advertising or a “sale” of personal information under certain state privacy laws, even if no money changes hands. You can exercise opt-out rights as described in Section 7.

2.3 No medical advice; not HIPAA

Kētos Products are dietary supplements and wellness products. The Services are not intended to provide medical advice, diagnosis, or treatment. We are not a “covered entity” under HIPAA, and information you provide to us is generally not treated as “protected health information” under HIPAA. Certain state laws may still apply to consumer health data; see Section 4.

3. Information disclosure

We do not disclose personal information to third parties for their own direct marketing purposes without your consent. We may disclose information as permitted by law and as described below.

3.1 Disclosures to service providers

We disclose information to vendors, contractors, and service providers that perform services on our behalf, such as:

  • Ecommerce platform services (including Shopify)
  • Payment processing and fraud prevention
  • Order fulfillment, shipping, and logistics
  • Customer support tools
  • Data hosting and storage
  • Security services
  • Analytics providers
  • Email and SMS delivery providers
  • Marketing and advertising partners (as described below)


Service providers are authorized to use information only as needed to provide services to us and as permitted by contract and law.

3.2 Advertising, analytics, and targeted advertising partners

We may disclose certain information (such as device identifiers, cookie identifiers, IP addresses, and usage data) to advertising and analytics partners to:

  • Deliver ads
  • Measure ad performance and attribution
  • Limit the number of times you see an ad
  • Conduct analytics and understand how users engage with the Site

As noted above, depending on your state, some of these disclosures may be considered “sharing” for targeted advertising or a “sale” under applicable state privacy laws. You can opt out as described in Section 7.

3.3 Affiliates

We may disclose information to our affiliates and related entities for the purposes described in this Privacy Policy, subject to applicable law.

3.4 Legal, safety, and compliance disclosures

We may disclose information if we believe disclosure is required or appropriate to:

  • Protect the rights, property, and safety of Ketos Health LLC, our users, customers, employees, or others

3.5 Business transfers

If Ketos Health LLC is involved in a merger, acquisition, financing, reorganization, bankruptcy, or sale of assets, information may be disclosed or transferred as part of that transaction, subject to applicable law.

3.6 Disclosures with your consent

We may disclose information for other purposes you authorize.

4. Consumer health data and sensitive information

4.1 Sensitive information generally


Some laws define “sensitive data” to include certain categories such as precise geolocation, government identifiers, or information about health conditions. We do not intend to collect sensitive data unless you choose to provide it or it is necessary to provide the Services.

4.2 Consumer health data

Some state laws regulate “consumer health data” broadly and can cover wellness-related information linked or reasonably linkable to a person (including information about dietary choices, supplement use, or health goals depending on context).

We may collect consumer health data only when you choose to provide it (for example, in a quiz, survey, customer support interaction, or preference setting). We use it to provide and improve the Services, personalize content where requested, and communicate with you consistent with this Privacy Policy.

Where required by law, we obtain affirmative, opt-in consent for collection and sharing of consumer health data beyond what is necessary to provide a product or service you request, and we provide a mechanism to withdraw consent.

4.3 Selling consumer health data

We do not sell consumer health data as that term is defined under applicable consumer health data laws without obtaining the specific authorization required by law.

4.4 Geofencing

We do not use geofencing to identify or track consumers seeking in-person healthcare services, collect consumer health data, or send targeted messages or advertisements based on consumer health data where prohibited by law.

5. Cookies and tracking

5.1 Cookies and similar technologies

We use cookies, pixels, tags, SDKs, and similar technologies (collectively, “cookies”) on our Services. Cookies help support core site functionality, improve performance, remember preferences, secure the Site, and (where enabled) support analytics and advertising.

Cookies may be set by us (first-party cookies) or by third parties (third-party cookies) such as analytics and advertising partners.

5.2 Types of cookies we may use

  • Strictly necessary cookies: required for core functionality such as shopping cart, checkout, security, and fraud prevention
  • Performance and analytics cookies: help us understand usage and improve the Services
  • Functional cookies: remember preferences (such as region or language)

5.3 Shopify cookie banner and third-party cookies

Shopify provides customer privacy settings and cookie tools that can govern certain Shopify-specific technologies (including certain cookies and Shopify pixels). If you have third-party cookies or pixels installed through apps or custom code, additional cookie controls may be required to ensure customer choices are honored.

5.4 Global Privacy Control and universal opt-out signals

In certain jurisdictions, a browser-based opt-out preference signal (such as Global Privacy Control) may be treated as a valid request to opt out of certain data disclosures for targeted advertising or “sale”/“sharing” of personal information. Where required, we will process such signals as a request to opt out.

5.5 Managing cookies

You can manage cookies through your browser settings. You may also be able to manage cookie preferences through a cookie banner or settings link on our Site (where available). Disabling cookies may affect Site functionality (for example, you may not be able to maintain a cart or remain logged in).

6. Social media and third-party services

Our Services may include links to third-party websites, plugins, social media features, or integrations. When you interact with those third parties, their own terms and privacy policies apply. We are not responsible for the privacy practices of third parties.

If you engage with Kētos on social platforms (for example, by commenting on a post or messaging us), we may receive information from the platform and process it as described in this Privacy Policy, subject to the platform’s settings and policies.

7. Your privacy rights (United States)

7.1 Overview

Depending on your state of residence, you may have rights to:

  • Access personal information we maintain about you
  • Delete personal information (subject to legal exceptions)
  • Correct inaccurate personal information
  • Obtain a copy of personal information (data portability) where applicable
  • Opt out of targeted advertising
  • Opt out of certain disclosures that may be considered “sale” or “sharing”
  • Limit the use and disclosure of certain sensitive personal information in some jurisdictions
  • Appeal a decision we make regarding your request in certain jurisdictions

  • Using a “Do not sell or share my personal information” link on our Site (if provided)
  • Enabling a browser-based opt-out preference signal such as Global Privacy Control (where applicable)
  • Adjusting cookie preferences (where available) and limiting third-party cookies/pixels via browser settings

7.4 Appeals

7.5 Non-discrimination

We will not discriminate against you for exercising your privacy rights.

8. California privacy rights (additional information)

If you are a California resident, California law provides additional rights and disclosures, including the right to know what categories of personal information we collect and disclose, the right to delete, the right to correct, and the right to opt out of sale or sharing (including via Global Privacy Control).

We collect the categories of information described in Section 1. We disclose information to the categories of recipients described in Section 3.

8.2 Sale or sharing

We do not sell personal information for money. However, our use of certain advertising and analytics technologies may involve disclosures that could be considered “sharing” for cross-context behavioral advertising or a “sale” under California law. You can opt out as described in Section 7.

8.3 Sensitive personal information

We do not use or disclose sensitive personal information for the purpose of inferring characteristics about you. If we collect sensitive personal information, we do so only as necessary to provide the Services, comply with law, or as otherwise permitted.

9. Choices

9.1 Email marketing

You can opt out of marketing emails by using the unsubscribe link in the email. Even if you opt out of marketing emails, we may still send non-marketing messages related to your account and transactions (for example, receipts or shipping updates).

9.2 SMS

If we offer SMS/text messaging, you can opt out by replying STOP or following the instructions provided at sign-up. Message and data rates may apply.

9.3 Account information

If you have an account, you may be able to access, update, or correct certain information through your account settings.

9.4 Withdrawing consent

Where we rely on consent (for example, in certain consumer health data contexts), you may withdraw consent by contacting us at privacy@ketoshealth.com. Withdrawing consent will not affect processing that occurred before you withdrew consent.

We retain information for as long as reasonably necessary to fulfill the purposes described in this Privacy Policy, including to:

  • Provide the Services and Products

  • Comply with legal obligations (including tax, accounting, and regulatory requirements)

  • Prevent fraud and maintain security


Retention periods vary depending on data type, sensitivity, and legal requirements. If you request deletion, we will take steps to delete or de-identify information as required, but we may retain certain information as permitted by law (for example, to complete a transaction, detect security incidents, comply with legal obligations, or maintain records of your request).

11. Security

We implement commercially reasonable administrative, technical, and physical safeguards designed to protect information. 12. Children’s privacy

Our Services are intended for adults. We do not knowingly collect personal information from children under 13. If we learn that we have collected personal information from a child under 13, we will take steps to delete it. 13. International users

Our Services are intended for residents of the United States. If you access the Services from outside the United States, you understand that your information may be processed in the United States and other jurisdictions where our service providers operate, which may have different data protection standards than your country.
